Privacy Policy

     1. INTRODUCTION

This document sets out the privacy policy of Mishel Piercy t/a MYP Consulting ABN 70 556 393 427 (referred to in this privacy policy as 'we’, ‘us’, or ‘our’).

We take our privacy obligations seriously and we’ve created this privacy policy to explain how we store, maintain, use and disclose personal information.

We are committed to preventing serious invasions of privacy and ensuring the protection of your personal information, so you can contact us using the details below if you have any questions or concerns. Although we are a small business, we have chosen to handle personal information consistently with the Australian Privacy Principles.

We provide data transformation, KPI analysis and spreadsheet template services to businesses. This privacy policy applies to:

(a) personal information we collect from visitors to our website, including through our enquiry form; and

(b) personal information we collect from our clients, and personal information contained in the data our clients provide to us so that we can perform our services.

Where we perform services for a client, our handling of that client’s data is also governed by our service agreement with that client. If there is any inconsistency between this privacy policy and that service agreement, the service agreement prevails.

By providing personal information to us, you consent to our storage, maintenance, use and disclosing of personal information in accordance with this privacy policy.

We may change this privacy policy from time to time by posting an updated copy on our website and we encourage you to check our website regularly to ensure that you are aware of our most current privacy policy.

     2. TYPES OF PERSONAL INFORMATION WE COLLECT

The personal information we collect may include:

(a) if you contact us through the enquiry form on our website, or otherwise contact us directly – your name, email address and telephone number, the content of your enquiry or message and any other information you choose to include in it, and any information you provide to us in later correspondence; and

(b) if you are a client, or you work for a client – your name, position, email address and telephone number, information about your business, and personal information contained in the data you provide to us so that we can perform our services, which may include information about your own clients, customers or personnel.

We do not seek or collect sensitive information (such as health information, or information about racial or ethnic origin, political opinions, religious beliefs, sexual orientation or criminal record) through our website. Please do not include sensitive information in an enquiry.

Data provided to us by a client may contain sensitive information, tax file numbers or government related identifiers. Our service agreement requires the client to tell us before providing data of that kind, so that we can handle it appropriately. Where we hold tax file number information, we handle it in accordance with the Privacy (Tax File Number) Rule 2015.

We do not sell anything through our website and we do not collect payment card or bank account details through it.

If you provide us with data that contains personal information about other people – including your own clients, customers or personnel – you must have obtained any consents, and given any notices, required under privacy law before you provide it to us. You are responsible for doing so, and our service agreement sets out your obligations in more detail.

     3. HOW WE COLLECT PERSONAL INFORMATION

We collect personal information directly from you when you:

(a) complete the enquiry form on our website;

(b) contact us by email or telephone; or

(c) provide us with information or data in the course of an engagement.

Our website is built and hosted using Wix. When you submit the enquiry form, your details are transmitted and stored through the Wix platform before we access them. Wix collects and handles information in accordance with its own privacy policy, available at www.wix.com/about/privacy.

     4. COOKIES AND WEBSITE ANALYTICS

Our website may use ‘cookies’ and similar technologies. Cookies are small files that store information on your computer, mobile phone or other device and enable and allow the creator of the cookie to identify when you visit different websites.

Our website platform sets cookies which are necessary for the website to function and to keep it secure. It may also set cookies which collect information about how visitors use the website, such as pages viewed and approximate location. We use that information only in aggregate, to understand how our website is used.

We do not use cookies to build a profile of you or to serve you advertising.

If you do not wish information to be stored as a cookie, you can disable cookies in your web browser. Some parts of our website may not work properly if you do.

     5. USE OF YOUR PERSONAL INFORMATION

We collect and use personal information for the following purposes:

(a) to respond to your enquiry and to contact you about our services;

(b) to provide our services to you and to communicate with you during an engagement;

(c) for record keeping and administrative purposes, including invoicing;

(d) to comply with our legal obligations, resolve disputes or enforce our agreements; and

(e) to improve our website and our services.

We will not use your personal information for any other purpose without your consent, unless we are required or permitted to do so by law.

We do not send marketing or promotional messages to people who contact us through our website unless they have asked us to. If we do send you marketing communications, we will comply with the (Cth) and you can opt out at any time using the unsubscribe facility provided or by contacting us using the details below.

 

     6. DISCLOSURE OF PERSONAL INFORMATION

We do not sell, rent or trade your personal information, and we do not disclose it to third parties for their own marketing or commercial purposes.

We may disclose personal information:

(a) to any subcontractor we engage to help perform our services, on the basis that the subcontractor is bound by confidentiality obligations no less protective than our own and, where the disclosure involves client data, only after we have notified the relevant client;

(b) to service providers who host our website or provide our email and file storage, and to our own accounting, insurance or professional advisers, in each case only so far as necessary and on the basis that they keep the information confidential;

(c) where we are required or authorised to do so by law; and

(d) where you have consented to the disclosure.

We do not use generative artificial intelligence, machine learning or similar third party tools to analyse personal  information or client data, and we do not upload, input or otherwise disclose personal information or client data to any such tool. This does not include incidental AI-assisted features built into standard office or spreadsheet software, such as autocomplete, formula suggestions or formatting recommendations, which do not transmit personal information or client data to a third party AI provider for training or independent processing.

If a client asks us to use a tool of that kind in connection with their engagement, we will do so only with that client’s prior written consent.

We do not use computer programs to make, or to substantially and directly assist in making, any decision that could reasonably be expected to significantly affect your rights or interests. If that changes, we will update this privacy policy to describe the kinds of personal information used and the kinds of decisions involved.

     7. STORAGE AND OVERSEAS DISCLOSURE

We store client data and working files on devices and systems under our control, and using cloud storage and file sharing services, including Google Shared Drive and Microsoft cloud services such as OneDrive and SharePoint.  

Before we hold a client’s data in a cloud service, we will tell that client. We take reasonable steps to ensure that access to that data is restricted to authorised personnel and protected by appropriate security measures, including password protection and access controls.

Our cloud storage, website and email providers, including Google, Microsoft and Wix, may store or process information on servers located outside Australia. Where that occurs, we take reasonable steps to ensure that the provider handles personal information in a manner consistent with this privacy policy, including through the provider’s own data protection commitments.

We do not otherwise send or store personal information overseas.

     8. SECURITY

We take reasonable steps to ensure your personal information is secure and protected from misuse or unauthorised access. Our devices and information technology systems are password protected, and we use a range of administrative and technical measures to protect them. However, we cannot guarantee the security of your personal information.

We limit access to personal information to those who need it in order to respond to your enquiry or to perform our services.

If a data breach occurs which is likely to result in serious harm to any individual whose personal information we hold, we will notify the affected individuals and, where the notifiable data breaches scheme under the (Cth) applies, the Office of the Australian Information Commissioner. Where the personal information was provided to us by a client, we will also notify that client as soon as reasonably practicable and work with them on their response.

     9. HOW LONG WE KEEP PERSONAL INFORMATION

We keep personal information only for as long as we need it for the purposes set out in this privacy policy, or for as long as we are required to keep it by law. When we no longer need it, we take reasonable steps to destroy it or to de-identify it.

We keep enquiry information only for as long as we need it to respond to your enquiry and for our own record keeping. We will delete it earlier on request.

We keep client information and client data in accordance with our service agreement with the relevant client. On completion of an engagement, or at the client's request, we return or securely delete or destroy that client's data, other than copies we are required to keep by law and one archival copy kept for our own records, which remains confidential.

   10. LINKS

Our website may contain links to other websites. Those links are provided for convenience and may not remain current or be maintained. We are not responsible for the privacy practices of those linked websites and we suggest you review the privacy policies of those websites before using them.

   11. REQUESTING ACCESS OR CORRECTING YOUR PERSONAL INFORMATION

If you wish to request access to the personal information we hold about you, please contact us using the contact details set out below including your name and contact details. We may need to verify your identity before providing you with your personal information. In some cases, we may be unable to provide you with access to all your personal information and where this occurs, we will explain why. We will deal with all requests for access to personal information within a reasonable timeframe.

We do not charge you for making a request. If giving you access would involve significant work, we may charge a reasonable fee to cover our costs, and we will tell you the amount before we proceed.

If you think that any personal information we hold about you is inaccurate, please contact us using the contact details set out below and we will take reasonable steps to ensure that it is corrected.

You can also ask us to delete the personal information we hold about you, and we will do so unless we are required to keep it by law or need it in connection with an existing engagement or a dispute.

If your personal information was given to us by one of our clients as part of the data we handle for them, we are not the right organisation to deal with your request. We will refer you, or your request, to that client, who is responsible for responding to it, unless the law requires us to respond ourselves.

   12. COMPLAINTS

If you wish to complain about how we handle your personal information or believe your privacy has been seriously invaded, please contact us using the details provided below with your name and contact details. We will investigate your complaint promptly and respond within a reasonable timeframe, usually within 30 days.

If you are not satisfied with our response, you may be able to make a complaint to the Office of the Australian Information Commissioner at www.oaic.gov.au or on 1300 363 992.
